The Occupational Safety and Health Administration's General Duty Clause clearly states that each employer has a duty to provide a safe work environment free of recognized hazards.

The FBI, Department of Labor, Bureau of Labor Statistics, The National Institute for Occupational Safety and now the Center for Disease Control (which declared WPV a national epidemic) all determined WPV to be a primary recognized hazard in the American workplace.

The criteria that the US courts use as the standard in ascertaining whether an employer acted reasonably in providing a safe work environment free from the recognized hazard of WPV is the following:

  1. Did they have a comprehensive policy covering all the various tenets of WPV avoidance (including domestic violence)?
  2. Have they provided all of their employees with professionally delivered training on how to avoid WPV?
  3. Have they implemented the required internal and external security controls?
